LICENCE APPLICATION (7 pages) Part 1
Exclusive Licence application to conduct local beauty contests in the country named below to select 3 candidates to represent the country in the grand final Commonwealth Triple Crown Beauty Contest, known as the “Miss, Miss Teen, and Mrs. Commonwealth International 2008 Contest”, in England, in Summer 2008, for the following international culture and charity beauty queen titles:

Part 2 PARTIES
1. The Promoter: Miss Commonwealth Pageant Limited The Promoter hereby grants the Licensee the exclusive rights to organize the local beauty contests to select the 3 candidates to represent the aforementioned country in the aforementioned grand final Commonwealth Triple Crown Culture and Charity Beauty Contest in Summer 2008, and undertakes to:- 1. Accept the 3 candidates to be selected by the Licensee as the country’s finalists and official entries to the said grand final contest. 2. Provide the Licensee with a national press release for the purpose of the local beauty contests to select the candidates to represent the country in the said grand final contest. 3. Give publicity to the local competitions, the local finalists, and the Licensee, on the Promoter’s website: www.misscommonwealth.org. 4. Set up a “Miss Commonwealth” domain name for the country in question, for the Licensee’s use, renewable at a cost to the Licensee, and the same shall remain the Promoter’s property. 2. The Licensee: The Licensee, whose particulars are stated in Part 5 of this document, hereby accepts the grant of the aforesaid exclusive rights and acknowledges the aforesaid Promoter’s undertakings, and furthermore, undertakes, at its sole expense, to observe the following and such other terms and conditions, rules, restrictions and obligations, as the Promoter shall introduce, from time to time, as necessary, and with adequate prior notice to the Licensee:- 1. To sponsor, find local sponsors for, finance, promote, arrange, organize, and conduct the local competitions in the aforesaid country to select the 3 candidates to enter as the country’s official entries in the said grand final contest. 2. To have completed the local contests to select the 3 candidates to represent the country, and to have completed their registration, with the Promoter, for entry in the grand final contest, by or before 30th May 2008 3. To submit each candidate’s completed and signed entry / registration form to the Promoter together with the contestant entry fee of a sum which shall be payable in UK Sterling for each of the 3 candidates, and of a magnitude which the Promoter shall state in separate correspondence to the Licensee. 4. To provide to the Promoter the photographs of the 3 candidates wearing their crowns and sashes for the Promoter’s website. 5. To provide, with the registration, two professional and recent colour photographs (one head-and-shoulder, and one full-body in swimwear or sportswear or other suitable and decent attire) of each of the 3 candidates, for judging purposes. 6. To ensure that the 3 candidates have the appropriate wardrobe of attire (namely, national costume, casual daywear, sportswear, and evening dress) for the grand final contest. 7. To provide the 3 candidates transportation to and fro the location, in London, England, for the grand final contest. 8. To find suitable sponsors for the local awards and prizes, and for the local promotion of the 3 winners, and to finance their registration and wardrobe for, and transportation to and fro, the grand final contest. 9. To provide the name(s) and company logo(s) of the sponsor(s) to the Promoter for their free publicity on the Promoter’s aforesaid website. 10. To ensure putting in place every necessary Health and Safety and insurance arrangement for the security of the candidates. 11. To conduct the selection of candidates in accordance with Miss Commonwealth Organisation’s (MCO’s) selection guidelines and criteria as outlined in the Entry Rules of the contest. 12. To abide by such other rules, terms and conditions as the Promoter may, from time to time, deem necessary and appropriate to introduce in the best interests of the integrity, reputation and security of the pageant, the contest, and the participants. Part 3 OTHER CONDITIONS: APPLICATION ADMINISTRATION/PROCESSING FEE: currently UK£500. LICENCE FEE: This Licence shall be subject to a non-refundable Licence Fee, the level of which shall be as applicable to the country for which the licence is required, under a fee-banding scheme based on the published Gross Domestic Products (GDPs) of the countries in the Commonwealth. The ruling Fee Levels are UK£2,000 for Band “A”, UK£1,500 for Band “B”, UK£1,000 for band “C”, and UK£500 for Band “D” GDPs. The GDP of the country for which this Licence is required is in Band “D”. Unless otherwise varied in writing, the Licence Fee for, and payable with the submission of, this application shall be UK£. EXCEPTIONAL CIRCUMSTANCES: The Licence Fee shall, however, be fully refundable if the Application is rejected for any reason, or in the unlikely event that the grand final contest were not to be proceeded with, for any reason. VALIDITY: 1. The Licence shall not be deemed valid until the Application has been approved and the Licence has been duly signed and dated by the parties above- mentioned. 2. The Licence shall be deemed valid for the year above-stated only. RENEWABILITY OPTION: This licence shall be renewable for the subsequent year, subject to terms, and to the renewal being requested by the Licensee and being completed by 31st January of that year. After that date, the renewability option shall lapse, and the licence for the country in that year shall be made available to other applicants. Renewability shall be subject to the Licensee’s satisfactory performance of the terms and conditions of the licence in the preceding year and to the Promoter’s discretion. LIMITATION(S): This Licence shall not constitute a Contract. The Licensee may wish to enter less than 3 candidates in the Contest. OBLIGATIONS: The Licensee shall carry out all the obligations in Part 2 of this Licence. STATEMENT OF FACT: The issue of this Licence shall rely upon the truthfulness and accuracy of the applicant’s particulars given in Part 5 of this document. The Licence shall immediately determine in the event that any of the particulars relied upon for the issue of the Licence shall be found to be inaccurate or untrue. SPECIAL PROVISION: Provided this Licence shall remain valid, the Promoter shall not grant another licence to any other organization/individual in respect of the country stated in this Licence in the year for which this Licence is granted. PROCEEDS FROM LOCAL CONTESTS: The proceeds from regional heats and local contests organized by the Licensee in the aforesaid country to select the country’s 3 final candidates for the international grand final contest shall be deemed the property of the Licensee. Part 4 GENERAL NOTES TO THE LICENCE APPLICATION Miss Commonwealth Organisation (MCO) welcomes offers from reputable Beauty Pageant Organisers (individuals or organisations) and other reputable organisations who wish to run local heats in their own countries to choose the 3 candidates to represent their countries in the grand final Triple Crown contest for Miss Teen, Miss, and Mrs Commonwealth International. To register as a Heat Organiser, the Heat Organisers Registration Form can be completed on-line (on the website at www.mcpint.org) or downloaded, and sent on-line or by post (address given) to Miss Commonwealth Pageant Organising Committee (MCPOC). Any individual or organisation who wishes to be their country's sole organiser of heats to select their country's 3 candidates for the grand final contest can apply to MCO for a monopoly (exclusive) Licence to run the heats. The annual Licence fee varies with the Gross Domestic Product (GDP) of countries and ranges from £500 (for the lowest GDP) to £2,000 (for the highest GDP). As an invariable practice, for the time-being, once an exclusive Licence has been granted to an organiser for a country, no other individual or organisation will be permitted to run a Miss Commonwealth heat for that country, in the year for which the Licence is granted. MCO will provide the Licence holder the press release to use for publishing the heats in the country. Also, the entries submitted by the Licensee will be accepted as the country’s finalists. By contrast, entries submitted by registered Heat Organisers who have not acquired an MCO exclusive licence will compete with other applicants to represent their country in the grand final contest. In the absence of a licensed organiser for any country, MCO will accept applications from registered Heat Organisers and from the country's citizens living at home or abroad, and will carry out the elimination process to choose finalists to represent the country in the grand final contest. Part 6 DECLARATION AND ENDORSEMENT By signing this Licence, the Licensee and the Promoter agree to be bound by all the terms and conditions above-stated, the Licensee declares to have read and understood the rules and regulations governing the contest, including the NOTES to the Licence Application.
